§ 40-23. Definitions.

  • (a)

    The following words and phrases when used in this article shall, for the purpose of this article, have the meanings respectively ascribed to them in this subsection, except when the context otherwise requires:

    Department means the police department of the city or its designated agent.

    Motor vehicle or vehicle.

    (1)

    The term "motor vehicle" or "vehicle" means a self-propelled device that can be used to transport or draw persons or property on a highway.

    (2)

    The term "motor vehicle" or "vehicle" does not include:

    a.

    A device exclusively used on stationary rails or tracks;

    b.

    Manufactured housing as defined by V.T.C.A., Occupations Code ch. 1201;

    c.

    An electric bicycle; or

    d.

    An electric personal assistive mobility device as defined by V.T.C.A., Occupations Code § 551.201.

    Notice of violation.

    (1)

    The term "notice of violation" means a notice mailed to a person identified as having violated this article and that complies with the content requirements set out in section 40-55.

    (2)

    The term "notice of violation" does not mean a criminal citation.

    Owner or registered owner means the owner of a motor vehicle as shown on the motor vehicle registration records of the state department of transportation or the analogous department or agency of another state or country.

    Photographic traffic signal enforcement system means a system that consists of a camera system and vehicle sensor installed to exclusively work in conjunction with an electrically operated traffic control signal and that is capable of producing at least two recorded images of the license plate attached to the front or rear of a motor vehicle that is not operated in compliance with the instructions of the traffic control signal.

    Recorded image means a photographic or digital image that depicts the front or rear of a motor vehicle.

    Traffic control signal means a manual, electric or mechanical device that alternately directs traffic to stop and to proceed.

    (b)

    Whenever any words and phrases used herein are not defined herein but are defined in the state laws regulating the operation of vehicles, any such definition therein shall be deemed to apply to such words and phrases used herein, except when the context otherwise requires.
