§ 40-1. Director of public works to install traffic control devices; duty to obey instructions of traffic control devices.

  • (a)

    Whenever the city council of the city shall, by ordinance, direct that a specific traffic control device shall be erected and installed upon, over, along, or beside any highway, street, or alley at a specific location, it shall be the duty of the director of public works to cause the same to be erected and installed in accordance with the directions in such ordinance immediately, or as soon as such specific device can be procured. Once the said device is installed, the director of public works shall file a signed report with the city secretary in writing, stating the type of traffic control device and when and where the same was erected and installed.

    (b)

    The driver of any vehicle shall obey the instructions of any official traffic control device applicable thereto, placed in accordance with the provisions of this article, unless otherwise directed by a traffic or police officer, subject to the exceptions granted the driver of an authorized emergency vehicle. No provision of this article for which official traffic control devices are required shall be enforced against an alleged violation, if at the time and place of the alleged violation, an official device is not in proper position.
