§ 16-108. Administrative stop order.

  • (a)

    The chief of police or his designee may issue an order to any person having possession or control over noise generating property to immediately halt any sound which exposes any person, except those excluded in subsection (b) of this section, to continuous or impulsive noise levels in excess of the limits set forth in section 16-82. Within five days following issuance of such an order, the chief of police or his duly authorized representative may apply to the appropriate court for an injunction to replace the administrative stop order.

    (b)

    No stop order shall be issued if the only persons exposed to sound levels in excess of the limits set forth in section 16-82 are exposed as a result of:

    (1)

    Trespass; or

    (2)

    Invitation upon private property by the person causing or permitting the sound.
